1. Introduction and acceptance

These Terms and Conditions (“Terms”) govern your access to and use of the website at https://3241.co.za (the “Website”), operated by 3241 Foundation NPC (“3241 Foundation”, “we”, “us”, “our”), a registered non-profit company and Public Benefit Organisation in South Africa (Section 18A No. 930073407, registered address 46 Impala Rd, Johannesburg, 2091).

By accessing or using the Website, creating a donor account, making a donation, submitting an application, or otherwise interacting with us through the Website, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Website.

These Terms should be read together with our Privacy Policy and Refund and Returns Policy.

 

2. About 3241 Foundation

3241 Foundation is a Public Benefit Organisation approved by SARS to issue Section 18A tax certificates for donations made in support of the following approved public benefit activities: community development for poor and needy persons, including skills development, anti-poverty initiatives, empowerment projects, and micro-enterprise support; and the care and rehabilitation of animals.

 

3. Eligibility and use of the Website

You may use the Website provided that you:

  1. are at least 18 years old, or are using the Website under the supervision of a parent or guardian;
  2. provide accurate and truthful information when creating an account, donating, or submitting any application; and
  3. use the Website only for lawful purposes.

     

    You agree not to:

    1. use the Website in any way that could damage, disable, overburden, or impair it;
    2. attempt to gain unauthorised access to any part of the Website, other users’ accounts, or our systems;
    3. use any automated system (bots, scrapers, etc.) to access the Website without our prior written consent;
    4. upload or transmit any content that is unlawful, defamatory, obscene, or infringes the rights of others; or
    5. use the Website to transmit any virus, malware, or harmful code.

     

    We reserve the right to suspend or terminate your access to the Website or your donor account if we reasonably believe you have breached these Terms.

     

    4. Donor accounts

    1. Registration. To make certain donations or manage recurring donations, you may need to register a donor account through our donor dashboard. You agree to provide accurate, current, and complete information, and to keep this information up to date.
    2. Account security. You are responsible for maintaining the confidentiality of your account login credentials and for all activity that occurs under your account. Please notify us immediately at info@3241.co.za if you suspect any unauthorised use of your account.
    3. Accuracy for tax purposes. Because your ID number and personal details are used to generate your Section 18A tax certificate, it is your responsibility to ensure this information is accurate. We are not responsible for tax certificates issued incorrectly as a result of inaccurate information provided by you.
    4. Suspension and termination. We may suspend or close a donor account at our discretion, including where we suspect fraudulent activity, misuse of the Website, or a breach of these Terms.

     

    5. Donations

    1. General. Donations made through the Website are voluntary contributions to 3241 Foundation in support of our public benefit activities. Donations may be made as a once-off donation or as a monthly recurring donation.
    2. Payment processing. All donations are processed through a third-party payment gateway (currently expected to be PayFast or Paystack, to be confirmed). By making a donation, you authorise the applicable payment gateway to process the payment on our behalf, in accordance with that provider’s own terms and privacy policy. We are not responsible for the acts or omissions of our payment gateway provider, including outages, delays, or errors in payment processing outside our reasonable control.
    3. Recurring donations. If you set up a monthly recurring donation, you authorise us (via our payment gateway) to charge your chosen payment method on a recurring monthly basis until you cancel. You may cancel your recurring donation at any time through your donor dashboard. Cancellation will take effect for future scheduled payments; it does not automatically refund any payment already processed. Please refer to our Refund and Returns Policy for further detail.
    4. No goods or services. Donations made to 3241 Foundation are gifts and do not entitle the donor to any goods, services, or benefit in return, except where explicitly stated (for example, a Section 18A tax certificate, where applicable).
    5. Section 18A tax certificates. Where a donation qualifies, we will issue a Section 18A tax certificate to the donor. The process and timing for issuing these certificates is currently being finalised; certificates will be issued in accordance with SARS requirements once confirmed. It remains the donor’s responsibility to ensure the accuracy of the personal information provided for this purpose.
    6. Refunds. Please see our separate Refund and Returns Policy, which forms part of these Terms.

     

    6. Apply for Support

    If you submit an application for support through the Website:

    1. submitting an application does not guarantee that support will be provided;
    2. we assess applications at our sole discretion, based on our available resources, programme criteria, and approved public benefit activities;
    3. you must provide accurate and truthful information in your application; we reserve the right to decline or withdraw support where information provided is found to be false or misleading; and
    4. any personal information (including any special personal information) you submit as part of your application will be handled in accordance with our Privacy Policy.

     

    7. Volunteer applications

    If you apply to volunteer with 3241 Foundation:

    1. submitting a volunteer application does not guarantee a volunteer placement;
    2. we may conduct reasonable vetting or ask for references before confirming a placement;
    3. no employment, agency, or contractor relationship is created between you and 3241 Foundation by virtue of a volunteer application or placement, unless separately agreed in writing; and
    4. any specific terms applicable to a particular volunteer role or programme will be communicated to you separately.

     

    8. Newsletter

    By signing up for our newsletter, you consent to receive periodic email communications from us about our work, programmes, and fundraising activities. You may withdraw this consent and unsubscribe at any time via the link provided in any newsletter email or by contacting us at info@3241.co.za.

     

    9. Comments and user-generated content

    1. Submissions. If you submit a comment, testimonial, or other content to the Website (“User Content”), you confirm that you have the right to submit it and that it does not infringe any third party’s rights.
    2. Licence. By submitting User Content, you grant 3241 Foundation a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit, and publish that content on the Website and in our other communications and marketing materials, for the purpose of promoting our work.
    3. Moderation. We reserve the right, but are not obligated, to review, edit, refuse to publish, or remove any User Content at our sole discretion, including content that is unlawful, defamatory, hateful, obscene, misleading, or otherwise inappropriate.
    4. Prohibited content. You agree not to submit User Content that is false, defamatory, infringing, harassing, or otherwise unlawful.

     

    10. Intellectual property

    All content on the Website, including text, graphics, logos, images, and design (excluding User Content and third-party content), is owned by or licensed to 3241 Foundation and is protected by South African intellectual property law. You may not reproduce, distribute, or create derivative works from this content without our prior written consent, except for personal, non-commercial use or as permitted by law.

     

    11. Third-party links

    The Website may contain links to third-party websites, including our payment gateway and social media platforms. We are not responsible for the content, privacy practices, or terms of any third-party website, and inclusion of a link does not imply endorsement.

     

    12. Disclaimer of warranties

    The Website is provided on an “as is” and “as available” basis. While we take reasonable steps to keep the Website accurate, secure, and available, we do not warrant that the Website will be uninterrupted, error-free, or free of viruses or other harmful components, and we make no warranties, express or implied, regarding the Website’s operation or the information, content, or materials included on it, except as required by South African law.

     

    13. Limitation of liability

    To the maximum extent permitted by law, 3241 Foundation, its directors, staff, and volunteers will not be liable for any indirect, incidental, or consequential loss or damage arising from your use of, or inability to use, the Website, including any loss arising from errors, delays, or interruptions caused by third-party service providers such as payment gateways or hosting providers. Nothing in these Terms limits any liability that cannot be excluded under South African law, including under the Consumer Protection Act 68 of 2008, to the extent it applies.

     

    14. Indemnity

    You agree to indemnify and hold 3241 Foundation harmless against any claims, losses, or damages arising from your breach of these Terms or your misuse of the Website.

     

    15. Changes to these Terms

    We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Continued use of the Website after any changes constitutes your acceptance of the updated Terms.

     

    16. Governing law and jurisdiction

    These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from these Terms or your use of the Website will be subject to the non-exclusive jurisdiction of the South African courts, Gauteng Division, Johannesburg.
